US Judge Orders Release of Kilmar Abrego Garcia from ICE Detention
A court has ordered the prompt discharge of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing confinement is without lawful basis.
"Since his release after erroneous detention in El Salvador, he has been taken back into custody, again without lawful authority," the judge stated in her order.
The situation stems from a erroneous deportation to El Salvador in March, which US authorities later admitted was an mistake. After his return to the United States to face human smuggling allegations, he was held in immigration custody.
In her order, the judge noted that the government lacks a valid deportation order, which prevents them from deporting Mr. Abrego Garcia "for now."
Context of the Legal Challenge
The court challenge involve disputed assertions. Whereas the former administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically denies this allegation.
He has also entered a not guilty plea to the conspiracy counts, which are part of a separate trial in the state of Tennessee.
Conditions of Release
The court, who was overseeing his petition to deportation in a federal court, ruled that he must now adhere to the terms of his bond from custody in Tennessee. This order effectively transfers his supervision to the Tennessee court.
This decision marks a notable development in a complex legal case featuring allegations of mistaken imprisonment and disputed criminal affiliations.
